Director of OPHD and Title IX Officer

The Director of the Office for Prevention of Harassment and Discrimination (OPHD) and Title IX Officer serves at the highest levels of the campus administrative organization, advising senior leadership on the General Campus, Scripps Institution of Oceanography, and UC San Diego Health in matters regarding nondiscrimination and harassment prevention to ensure that the campus provides an environment for students, faculty, and staff that is free from discrimination and harassment based on sex, race, and other protected categories outlined in university nondiscrimination policies. The Director of OPHD and Title IX Officer is considered a subject matter expert on campus and serves as lead strategist for preventing discrimination and harassment and represents the campus with constituencies such as faculty, Academic Senate, senior administrators, UC Office of the President, public agencies, and the community. The Director of OPHD and Title IX Officer is responsible for developing and managing all institutional compliance efforts on nondiscrimination and harassment prevention.

 

Reporting to the Chief Ethics and Compliance Officer, the Director of OPHD and Title IX Officer administers campus gender discrimination, sexual violence and sexual harassment policy and complaint resolution procedures, and is responsible for developing and administering campus-wide harassment prevention and anti-discrimination trainings, Title IX sexual harassment prevention training, education programs, and sexual assault awareness training for all faculty, staff and students. The Director of OPHD and Title IX Officer provides strategic guidance, advising and decision making in all areas pertaining to compliance and nondiscrimination on the basis of sex (e.g., Title IX, Title VII, Violence Against Women Act and other related state and federal regulations and UC policy requirements), as well as other protected categories outlined in university nondiscrimination policies and federal/ state law. The Director of OPHD and Title IX Officer is responsible for developing and managing institutional compliance efforts on gender discrimination, sexual harassment, retaliation, sexual assault, athletics equity, and related civil rights investigations for UC San Diego.

Job Requirements

QUALIFICATIONS

• Law degree (JD) from an American Bar Association accredited law school or Advanced degree or an equivalent combination of education and experience.

• Minimum of three years of experience in sexual violence, sexual harassment, or discrimination and harassment law (such as Title VI, Title VII, Title IX, Violence Against Women Act, Americans with Disabilities Act).

• Minimum of three years of experience in conducting employment or education/student discrimination, harassment, and retaliation investigations.

• Minimum of three years of experience working in higher education.

• Preferred: Minimum of 2 years of experience working with an academic medical center or healthcare setting.

• Broad knowledge of compliance issues in higher education in the State of California and Federal programs and regulations, or equivalent regulatory knowledge/experience in another state.

• Broad knowledge of the organizational environment of higher education and large research universities to understand priorities, issues, motivations and constraints.

• Broad knowledge of organizational processes, protocols and procedures.

• Demonstrated consulting, relationship building and strategic thinking skills. Advanced use of these skills in guiding the campus toward workable strategies and solutions. Advanced ability to exercise sound judgment in all matters.

• Advanced investigation training or equivalent experience.

• Thorough understanding of Title VI, Title VII, Title IX, VAWA, FEHA and state and federal guidance and laws relating to harassment and discrimination.

• Full understanding of fundamental fairness, due process, and how both fit into a trauma informed process.

• Demonstrated ability to develop and deliver effective training regarding discrimination and sexual harassment, Title VII, Title IX, the Violence Against Women Act and discrimination based on protected categories.

• Ability to determine, based on evidence, whether violations of policy or harassment / discrimination laws have taken place and maintain appropriate confidentiality.

• Proven leadership abilities to establish department goals, and motivate and influence others to achieve. Strong supervisory skills to maintain an effective staff.

• Demonstrated ability to ensure proper record-keeping, understand data management processes and ensure appropriate data is properly collected and maintained.

• Skills to effectively lead highly significant engagements from inception to conclusion.

• Advanced analytical, problem-solving, project planning and implementation skills. Thorough analytical skills to review data to analyze for trends, patterns, and systemic issues.

• Highly-skilled in navigating complex organizations.

• Advanced written, verbal and presentation skills for influencing and facilitating sustained change.

• Skill and sensitivity to interact with diverse constituencies of various ethnic, social, cultural, economic and educational backgrounds in order to facilitate problem resolution and to educate members of the University community effectively.
